Privacy Policy

Dealer Network Associates, LLC (“Dealer Network”) appreciates the privacy of users of its ZILLIDEX™ online system (“Users”). To that end, this Privacy Policy (the “Privacy Policy”) is to assist you in understanding what information Dealer Network collects in the ZILLIDEX system through the website located at www.ZILLIDEX.com (the “ZILLIDEX System”), and how it handles such information. This Privacy Policy applies to any use of the ZILLIDEX System.

Dealer Network may change the terms of this Privacy Policy at any time. Dealer Network recommends that you review this Privacy Policy periodically to learn of new practices or changes to it.

1. The Information Dealer Network Collects About You and How Dealer Network Uses It

Dealer Network collects information about you to enhance the ZILLIDEX System and make it easier and more efficient for you to use. If you choose to utilize the products or services Dealer Network offers through the ZILLIDEX System, you may be asked to provide certain information about yourself, such as your name, address, phone number, and email address. You may elect not to provide Dealer Network with certain information online; however, this may limit the extent to which you can utilize the ZILLIDEX System.

In addition, Dealer Network automatically gathers certain usage information, such as the number and frequency of visitors to the ZILLIDEX System, length of stay, and other anonymous data. This data helps Dealer Network determine usage levels on different parts of the ZILLIDEX System and to conduct other internal research. Dealer Network may aggregate such data and disclose it in an anonymous manner to third parties or as required by law.

Dealer Network also monitors the use of passwords and account credentials used in connection with the ZILLIDEX System, and collects information regarding how credentials are used and by whom. This monitoring is conducted for security purposes and to verify that each user is authorized for the functions they are performing. The platform maintains an activity log on the server that records the IP address of users accessing the system.

The ZILLIDEX System uses cookies and browser storage mechanisms for authentication, session management, and user experience functionality. The platform uses persistent cookies to maintain login information between browser sessions, including storing a user authentication token for the “Remember Me” functionality. If you choose to decline cookies from the ZILLIDEX System, you may not be able to use some sections of the ZILLIDEX System or it may hinder the ZILLIDEX System’s functions.

Account and Authentication Information. The platform collects and maintains the following account and access-related information for security and operational purposes:

• Login history
• Authentication logs
• Failed login attempts
• IP addresses associated with account access
• Device information

Vehicle and Inventory Data. As a dealer-to-dealer inventory platform, the ZILLIDEX System collects, stores, processes, displays, and shares the following types of vehicle and inventory data:

• Vehicle Identification Numbers (VINs)
• Vehicle descriptions and photographs
• Vehicle pricing information
• Vehicle location information
• Odometer and mileage information
• Title and ownership information
• Dealer inventory feeds
• Trade and transaction-related information

This information is shared with other licensed dealers who are members of the ZILLIDEX dealer network.

Subscription and Billing Information. The platform collects and retains the following billing and subscription-related information:

• Billing address provided at registration
• Subscription records
• Billing dates, payment history, transaction IDs, and payment status
• Authorize.net Customer Profile ID and Payment Profile ID
• Last four digits of the payment card on file

Payment processing is handled through Authorize.net. Dealer Network does not store full payment card numbers or ACH and bank account information.

Technical and Usage Information. The platform automatically collects the following technical information:

• IP addresses
• Browser type and version
• Operating system information
• Device identifiers
• Log file information
• Referring URLs

2. How Dealer Network Shares or Discloses Your Information

As a matter of policy, Dealer Network will not sell, share, or rent information about you or your business that Dealer Network collects on the ZILLIDEX System in ways different from the following:

• Dealer Network may disclose such information if you consent to such disclosure, including, but not limited to, when you indicate that you would like Dealer Network to provide you or a related party with Dealer Network products or services.
• Dealer Network may disclose such information to companies and individuals Dealer Network employs or engages to perform services on its behalf, including, but not limited to, analyzing data, maintaining Dealer Network servers, or hosting the ZILLIDEX System. Current service providers include Mystic Media (hosting), Network Solutions (hosting and SMTP/email delivery services), and Authorize.net (payment processing). Dealer Network may also engage dealer verification or inventory integration providers where applicable. These companies and individuals will have access to your information only to the extent necessary to perform their functions. ZILLIDEX retains the right to employ or engage other third-party vendors or service providers in its sole discretion.
• Dealer Network may disclose vehicle and inventory data submitted to the platform with other licensed dealers who are members of the ZILLIDEX dealer network.
• Dealer Network may also disclose information to the government or third parties when Dealer Network, in its sole discretion, believes necessary or appropriate in connection with activity that is illegal or may expose Dealer Network or you to liability, or to protect Dealer Network users or the public.
• Dealer Network may disclose and transfer such information to a third party that acquires all or substantially all of Dealer Network’s business or operations.

Dealer Network does not sell personal information, use personal information for targeted advertising, or allow advertising or analytics providers to collect information through the platform.

3. Data Retention

Dealer Network retains information as follows:

• User account information: retained indefinitely. Dealer accounts are not permanently deleted but may be set to inactive status. User accounts may be disabled by the dealer account owner.
• Vehicle listings and inventory data: retained indefinitely. Inventory data is removed upon dealer account deactivation.
• Usage and access logs: retained indefinitely.
• Support communications: retained indefinitely.
• Billing and subscription records: retained indefinitely for operational, accounting, and legal purposes.
• Server backups: three daily backups of the entire cloud server, retained for 30 days.

4. Data Security

Dealer Network employs the following security measures to protect information collected through the ZILLIDEX System:

• HTTPS/SSL 256-bit encryption for all web traffic
• User passwords stored using industry-standard hashing
• IP address logging for account access monitoring

5. Children

Dealer Network believes that it is especially important to protect children’s privacy online. Dealer Network does not knowingly collect or use any personally identifiable information from children under the age of thirteen (13), and does not knowingly provide any personally identifiable information, regardless of its source, to any third party for any purpose whatsoever from visitors younger than thirteen (13) years old. No information should be submitted to or posted through the ZILLIDEX System by visitors younger than thirteen (13) years old.

6. Changing Your Information

You may review, update, correct, or change the information you provide to the ZILLIDEX System by contacting Dealer Network directly through the contact link on the website or at INFO@ZILLIDEX.com. A self-service account management feature is currently under development and will be made available through the ZILLIDEX System upon completion.

7. Your Privacy Choices

Users may opt out of marketing communications by contacting Dealer Network at INFO@ZILLIDEX.com. Users may also request that Dealer Network update or correct inaccurate personal information associated with their account, as described in Section 6 above. Requests to delete account information or export account data are not currently available through the ZILLIDEX System. Please note that certain information cannot be deleted even upon request, including billing and payment records, transaction history, and other information that Dealer Network is required to retain for operational, accounting, or legal purposes. Similarly, historical business records associated with a dealer account are retained following deactivation and are not subject to deletion requests.

8. Changes to This Privacy Policy

Dealer Network reserves the right, in its sole discretion, to modify, update, or otherwise revise this Privacy Policy at any time. Such revisions shall be effective immediately upon posting on the ZILLIDEX System. Dealer Network recommends that you review this Privacy Policy periodically to learn of new practices or changes.
